Applicable terms and conditions

The following terms and conditions apply to all orders placed via the www.drivao.com e-shop. These provisions and conditions govern the sale by Speed-up srl as mentioned on the invoice that will be sent for all orders of products sold by Speed-up srl (VAT: BE 0477 924 839), unless a separate formal purchase contract has been concluded with Speed-up srl.

By ordering products from www.drivao.com or by accepting delivery of the products mentioned on the invoice, you acknowledge and accept these terms and conditions. Speed-up srl reserves the right to modify these provisions and conditions at any time and without prior notice. Speed-up srl also reserves the right to make changes to its products in relation to the information provided on its website www.drivao.com.

Registration

When you register on the www.drivao.com website, you are solely responsible for the data you enter. Make sure that the mandatory data you provide is accurate and complete. The password given to you when you register on the www.drivao.com website is strictly confidential and must not be passed on to third parties. You assume full responsibility for orders placed, even without your knowledge, using your connection parameters (login and password). If you suspect that a third party is using your connection parameters, you must inform Speed-up srl as soon as possible. Speed-up srl will provide you with new parameters.

Ordering and prices

All prices on the www.drivao.com e-shop are in euros and include VAT. Payments are debited in euros. Please read the product description and technical details carefully before placing an order. If you have any questions about a product, you can always send an e-mail to info@drivao.com. Orders placed via www.drivao.com will only be accepted by Speed-up srl once you have received a confirmation notice on your screen stating that the order has been successfully processed and that payment has been approved.

Payment methods

Speed-up srl accepts various methods of payment for the products presented on the www.drivao.com website: bank cards, paypal, Apple pay/Google pay, ideal and bank transfer. Delivery is free. Payment is possible with VISA, Eurocard/Mastercard, American Express & Bancontact Mister Cash. The amount due is debited in euros. If you choose to pay by credit card, the money is immediately withdrawn from your account when payment is confirmed. Speed-up srl cannot be held responsible for any additional costs or charges resulting from transaction fees or exchange rate fluctuations. Make sure that the credit card number and expiry date are correct. False information may slow down the processing of your order. Payment by credit card is subject to the approval of the financial institution issuing the card. Speed-up srl cannot be held responsible if a financial institution refuses to accept or honour the credit card for any reason whatsoever. Speed-up srl takes all reasonable precautions, insofar as the company is authorised to do so, to secure the details of your order and payment. Barring negligence, Speed-up srl cannot be held responsible for any losses resulting from the fact that a third party may have illegitimately accessed the data you provided when visiting www.drivao.com or placing an order.

Shipping and negotiation

You acknowledge and accept payment of all shipping and negotiation costs, as well as payment of VAT and any other levies applicable to your order. The charges are automatically calculated for you and debited from your credit card account at the same time as the total purchase price of the product when your order is dispatched. Actual costs may vary and are charged on the invoice. Speed-up srl works with various delivery companies to send your order. This is why it is impossible to deliver to P.O. Box addresses. The dispatch and delivery details given are nothing more than ideal estimates and Speed-up srl cannot be held responsible for any loss, damage or costs caused by failure to comply with the dispatch and delivery details given.

Delivery times

As a manufacturer, Speed-up srl is committed to keeping delivery times as short as possible. However, if this period exceeds 10 days, Speed-up srl will contact the customer to inform them of when their order will be delivered. If you purchase more than one Drivao module in the same order, Speed-up srl reserves the right to work with partial shipments (staggered deliveries) and to save the remaining products as backorder for future deliveries, unless you immediately inform Speed-up srl when placing the order that you accept “full delivery only”. You acknowledge and accept that deliveries of orders that “can only be delivered complete” may be delayed due to your request.

Return within the first 30 (thirty) days

If you are not completely satisfied or if the product has a defect within the first thirty days of receipt, you may return it for a refund or replacement at your expense. Before returning goods, which must be received by us no later than 30 days after the invoice date, you must send us an e-mail stating the following details: invoice number and date, product number (reference) and reason for return. Reimbursement will only be made by bank transfer within 30 days of receipt of the goods returned by the customer and receipt of their bank details by e-mail.

Return procedure

The invoice number is also your TTG number. The TTG number must be clearly marked on the return packaging. Returns without a TTG number and a copy of the original invoice will not be accepted. Goods must be returned in their original packaging, with all components supplied: module(s), remote(s), cabling, connectors and accessories. Incomplete products will NOT be accepted. Only Drivao in new condition can be returned to us. Products with scratches or other damage will not be refunded. All return and negotiation costs must be paid in advance by the customer. Force majeure

Speed-up srl cannot be held responsible for any loss or damage resulting from delays or non-compliance with its obligations under this contract due to strikes, lock-outs, revolts, war, fire, natural disasters, accidents, shortages among suppliers or manufacturers of Drivao equipment, restrictions by the authorities, failure to grant import or export permits, infringement of laws, regulations or orders, or due to other circumstances or causes that prevent the correct observance of these provisions and conditions, or other causes beyond the control of Speed-up srl.

Applicable law and jurisdiction

The sale of the products is governed as far as possible by Belgian law and the parties acknowledge the exclusive jurisdiction of the Commercial Court of Verviers (Belgium).

Use of electronic messages

Products are sold electronically on the www.drivao.com eshop. You therefore authorise Speed-up srl to communicate with you electronically. Speed-up srl may send you e-mails and other communications about your order via the Internet. You agree to the fullest extent of the law that this provision supersedes any laws that provide other methods or timing for the receipt of messages about your order. Speed-up srl reserves the right to send messages and notifications by means other than normal mail, as well as the right to receive written messages insofar as this method is prescribed elsewhere in this contract. In the event of a dispute, you undertake, in the broadest legal sense, not to call into question the evidential value of electronic orders, communications, messages or notifications in the context of this contract.

Guarantee

The Drivao modules are guaranteed for a period of five years from the date of purchase indicated on the purchase invoice. This guarantee is provided by our repair centre and covers all parts of the product as well as labour. In order to provide you with the best possible service, please complete the registration card enclosed with the module and return it to our Service Centre (Speed-up srl – 12, Avenue Andromède – B-4802 Heusy – Belgium) within fifteen days of the date of purchase. In the event of a fault during the warranty period, you can contact the Service Centre to report the problem, then return the module to the Service Centre. Our Service Centre will repair the module and return it to you within 5 days of receipt. The Speed-up srl guarantee does not cover damage caused by incompetent use, placing the module close to a part of the motor that is subject to overheating, incorrect fixing of the box or wiring, accident, fire, water damage, dropping or impact, incorrect connection, unauthorised modifications, failure to follow the instructions provided by Speed-up srl or any repairs carried out by a centre not approved by Drivao. Drivao reserves the right to repair the module either in its own workshops or to appoint another for this purpose. Changes of address must be notified in writing to Speed-up srl in writing, otherwise the guarantee will be invalidated.

Warning

Our company declines all responsibility for the refusal of insurance cover, a manufacturer’s warranty, or in the event of mechanical or electronic damage to the vehicle fitted with the DRIVAO.

Full contract

The provisions and conditions in this contract between Speed-up srl and yourself constitute the full and final confirmation of the agreements and conventions between the parties concerning the content of this contract and they replace all previous written and verbal conventions, contracts or discussions. The fact that Speed-up srl does not require the application of a provision or condition of this contract or of its rights under this contract does not mean that Speed-up srl waives its rights or possibilities of recourse under this contract.
